Terms of Service
Effective date: July 2, 2026
These Terms of Service (the "Terms") are a legal agreement between you and Victus Inc. ("Victus," "we," "us," or "our") governing your use of the Victus mobile application, website at https://victus-us.com, and related services (together, the "Service"). By creating an account, subscribing, placing an order, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Please also read our Privacy Policy, which explains how we collect and use your information and is incorporated into these Terms by reference.
1. What Victus Is
Victus is a weekly meal-plan subscription service that arranges the preparation and physical delivery of prepared meals to you. Each week you build a meal plan for an upcoming week; we coordinate with partner restaurants and kitchens to prepare your selected meals and arrange delivery to your address.
- Meals are prepared by independent partner restaurants and kitchens, not by Victus. We do not cook, package, or manufacture food.
- Delivery is performed by independent third-party couriers arranged through Uber Direct. Victus does not employ the couriers and does not operate a delivery fleet.
- Your meal plan runs on a Monday-through-Sunday weekly cycle in U.S. Eastern Time (America/New_York).
Menus, meal availability, restaurant participation, prices, and delivery coverage may change at any time.
2. Eligibility and Accounts
2.1 Eligibility
- You must be at least 18 years old and able to form a binding contract to use the Service.
- The Service is currently offered only in the United States. Delivery addresses must be within the United States, and availability depends on whether a participating kitchen serves your address (see Section 8).
2.2 Creating an account
You can create an account with your name, email, and a password, or by signing in with Google or Apple. Passwords must be at least 8 characters and include letters, numbers, and symbols. You are responsible for keeping your login credentials secure and for all activity under your account.
2.3 Verification required before you can subscribe or pay
- Email verification. You must verify your email address before a subscription can be activated.
- Phone verification. You must add and verify a mobile phone number before you can pay for a subscription. We require a reachable phone number so that couriers and support can contact you about your delivery. Verification is completed by a one-time code sent by SMS.
You agree to provide accurate, current, and complete information and to keep it up to date, including your delivery address and phone number.
3. Subscription and Billing
3.1 Weekly billing cycle
Victus bills on a weekly cadence. Each Sunday evening (U.S. Eastern Time), we calculate and charge the total for your upcoming Monday-through-Sunday week and, once payment succeeds, create your orders for that week. Billing is tied to the meals in your plan for the coming week — if you have no meals planned for a week, there is no charge for that week.
3.2 How your weekly total is calculated
Your weekly total is calculated by us and equals the sum of:
- the price of each meal in your plan for that week;
- any price differences from customizations you make to those meals; and
- a per-meal delivery fee for each meal to be delivered.
The current per-meal delivery fee is shown in the app before you confirm your plan. Delivery fees are set by Victus and may change from time to time.
3.3 How you are charged
- Payments are processed by Stripe. You authorize us to store your default payment method with Stripe and to charge it automatically ("off-session") each week for that week's total. Victus does not store your full card number.
- Before charging your card, we automatically apply any available meal-token balance to reduce the amount due ("tokens-first"). If tokens cover the entire weekly total, no charge is made to your card that week. See Section 5.
- Your orders for the week are created only after the charge clears. If a charge fails, the corresponding orders are not created.
3.4 Payment methods
You may pay with a supported credit or debit card, and — where available on your device — Apple Pay or Google Pay through the in-app payment sheet. You are responsible for keeping a valid payment method on file. If your payment method fails, we may be unable to place your orders for that week.
4. Order Changes and the Order Lock Window
You can edit your plan and customize meals up until each order's lock time, which is 2 hours before that order's scheduled delivery time. Once an order locks (2 hours before delivery), it can no longer be changed, cancelled, or customized — the system hard-blocks any modification to a locked order.
- Before lock, you can add, remove, swap, or customize meals.
- After lock, an order is final. Preparation and courier arrangements are already underway (for example, orders are sent to the preparing restaurant roughly 90 minutes before delivery, and a courier is reserved around the lock time).
There is no separate 24-hour change deadline; the 2-hour lock is the applicable cutoff for each order.
5. Meal Tokens
Meal tokens are an in-app credit balance you can use toward meals and delivery fees. Tokens are a convenience feature, not money.
5.1 How you get tokens
- Credited automatically when a future order is cancelled or removed (see Sections 6 and 7).
- Credited as a "downgrade credit" when you change a meal to a lower-priced option after that week has already been billed (see Section 6.2).
- Credited when you add funds: adding funds charges your card first and then credits the corresponding tokens to your balance.
- Credited through eligible promotional or supporter redemptions, where offered.
5.2 How tokens are used
- Tokens are applied automatically toward your next weekly bill before your card is charged ("tokens-first").
- Tokens are also applied first toward mid-week meal swaps and customization upgrades (see Section 6).
5.3 Token expiration and value
- Tokens expire 90 days after they are credited. Expired tokens are forfeited.
- Tokens have no cash value, are non-transferable, and cannot be redeemed or cashed out for money.
- If you delete your account, any remaining token balance is forfeited (see Section 12).
6. Customizations, Swaps, and Additional Charges
6.1 Changes to a week that has not yet been billed
If you change your plan for a week that has not yet been billed, your plan simply updates and the correct total is calculated when that week is billed on Sunday. No separate immediate charge applies.
6.2 Changes to a week that has already been billed
- Upgrades (higher-priced change). If you swap or customize a meal to a higher-priced option after that week has been billed, the price difference is paid tokens-first, then charged to your card for any remaining balance.
- Downgrades (lower-priced change). If you change to a lower-priced option after billing, the price difference is credited to you as meal tokens (which expire in 90 days). Downgrades are refunded as token credit, not as cash back to your card.
- Order customization ("Apply & Pay"). When you customize an already-placed order, the net difference is settled as a single transaction using the same tokens-first, then card approach.
All such changes must be made before the affected order's 2-hour lock (Section 4).
7. Cancellation and Pause
7.1 Cancellation
You can cancel your subscription at any time from the app. Cancellation takes effect immediately (it is not deferred to the end of a cycle):
- Your subscription is cancelled right away and future weekly billing stops.
- Any of your upcoming, not-yet-locked orders are automatically cancelled, and you are credited meal tokens for those cancelled orders.
- Cancellation does not, by itself, provide a cash refund. Your remedy for cancelled future orders is meal-token credit (subject to the 90-day expiration in Section 5).
7.2 Pause
You can pause your subscription instead of cancelling. While paused, weekly billing is stopped — the weekly charge only runs for active subscriptions. You can resume at any time to reactivate weekly billing.
7.3 Deleting your account
You can permanently delete your account and data at any time. See Delete your account and Section 12 for what happens on deletion.
8. Delivery Terms
8.1 Service area
Delivery availability depends on partner kitchens. Each participating restaurant serves addresses within a delivery radius (by default about 2 miles, which a restaurant may adjust). If no participating kitchen serves your delivery address, the Service may be unavailable to you. We do not guarantee availability in any particular city, ZIP code, or region.
8.2 Couriers and tracking
- Deliveries are carried out by independent couriers arranged through Uber Direct. To arrange delivery, we share the information needed to complete it, including your name, phone number, delivery address, and meal details. This is described further in our Privacy Policy.
- Where available, you can follow your delivery through a courier tracking link hosted by Uber. Victus does not track your own device's location for delivery, and we do not control courier routing or timing.
8.3 Your responsibilities
You are responsible for providing an accurate, complete, and reachable delivery address and phone number, and for being available to receive your delivery at the scheduled time. Because meals are perishable and prepared to order, we cannot guarantee redelivery if a delivery cannot be completed due to inaccurate address information, an unreachable phone number, or your unavailability. Delivery times are estimates and are not guaranteed.
9. Nutrition, Ingredients, and Allergy Disclaimer
Please read this section carefully if you have a food allergy, intolerance, or medical dietary restriction.
- Nutrition information is advisory and approximate. Calorie counts, macronutrient values, and other nutrition figures shown in the Service are estimates provided for general informational purposes only. They are not medical, nutritional, or dietary advice, and actual values may vary.
- Ingredient and allergen information comes from partner restaurants and may be incomplete, inaccurate, or out of date, and may change without notice. Menu items may be reformulated at the restaurant's discretion.
- You are responsible for verifying allergens. If you have a food allergy or sensitivity, you must confirm ingredients and preparation details directly with the preparing restaurant before consuming any meal. Do not rely solely on the information shown in the app.
- Cross-contamination is possible. Meals are prepared in kitchens that handle common allergens (such as nuts, dairy, eggs, wheat, soy, fish, and shellfish). We cannot guarantee that any meal is free of any particular allergen or free from cross-contact.
- Victus does not collect a personal allergy or dietary-restriction profile and does not filter meals for your specific allergies. You are solely responsible for choosing meals appropriate for your health needs.
To the fullest extent permitted by law, Victus is not liable for any allergic reaction or adverse health effect resulting from meals ordered through the Service. If you have a serious allergy or medical condition, consult a qualified professional and confirm details with the restaurant before ordering.
10. Acceptable Use
When using the Service, you agree not to:
- use the Service for any unlawful, fraudulent, or abusive purpose, or violate any applicable law or regulation;
- provide false, misleading, or someone else's information, or impersonate another person;
- use another person's payment method without authorization, or attempt to evade, reverse, or manipulate charges, tokens, credits, or promotions;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, our systems, or our partners' systems;
- copy, scrape, reverse engineer, decompile, or attempt to extract source code from the Service, except where such restriction is prohibited by law;
- resell, redistribute, or commercially exploit the Service or the meals without our written permission; or
- harass, threaten, or harm couriers, restaurant staff, our personnel, or other users.
We may suspend or terminate your access if we reasonably believe you have violated these Terms or misused the Service.
11. Intellectual Property
The Service, including its software, design, text, graphics, logos, and the "Victus" name and marks, is owned by Victus Inc. or its licensors and is protected by intellectual property laws. Menu content, restaurant names, and related materials belong to the respective partner restaurants or their licensors.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. All rights not expressly granted are reserved. You may not use our trademarks without our prior written consent.
12. Account Deletion and Data Retention
When you delete your account:
- We first cancel any active subscription with Stripe. If that cancellation cannot be completed, deletion is stopped so that you are not left being billed on a deleted account.
- We cancel your pending and in-progress orders.
- We delete your account and associated records in our systems, including your profile, addresses, subscription, orders, plans, notifications, invoices, token ledger, saved push-notification tokens, and meal customizations.
Please note:
- Your meal-token balance is forfeited on deletion and is not refundable.
- Records already transmitted to our payment, delivery, and restaurant partners (for example, Stripe charge and invoice history, and completed Uber or restaurant order records) are retained by those partners under their own policies and are not deleted by us.
- We may retain limited records as required for legal, accounting, security, fraud-prevention, or dispute-resolution purposes.

13. Third-Party Services
The Service relies on third-party providers to function, including Stripe (payments), Uber Direct (delivery), partner restaurants and their point-of-sale systems, cloud hosting and authentication, push-notification delivery, mapping and address lookup, SMS verification, and sign-in with Google or Apple. Your use of features provided by these third parties may also be subject to their terms and policies. We are not responsible for the acts, omissions, products, or services of third parties.
14. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that meals, delivery, or information will meet your expectations. Food is prepared by independent restaurants; we do not warrant the quality, safety, or suitability of any meal. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
15. Limitation of Liability
To the fullest extent permitted by law, Victus Inc. and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of the Service, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to Victus for the Service in the 30 days before the event giving rise to the claim, or (b) fifty U.S. dollars (US$50). Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnification
You agree to indemnify and hold harmless Victus Inc. and its officers, employees, and partners from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.
17. Your Privacy and Consumer Rights
Your use of the Service is also governed by our Privacy Policy. Depending on where you live, you may have rights over your personal information — for example, under the California Consumer Privacy Act (CCPA/CPRA) or, where applicable, the EU/UK General Data Protection Regulation (GDPR) — including rights to access, correct, delete, or obtain a copy of your data, and to opt out of the sale or sharing of personal information. We do not sell your personal information. You can exercise deletion directly through Delete your account, or contact us using the details in Section 21. Our Privacy Policy explains these rights and how to exercise them in more detail.
18. App Stores
If you download the Victus app from a third-party app store (such as the Apple App Store or Google Play), your use is also subject to that store's terms. The app store provider is not a party to these Terms and is not responsible for the app or its content. Where required by the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them, and any support or warranty obligations for the app are ours, not Apple's.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Changes take effect when posted. Your continued use of the Service after an update means you accept the revised Terms. If you do not agree to a change, please stop using the Service and, if you wish, delete your account.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Subject to any rights you have under applicable consumer-protection law, you agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section deprives you of the protection of mandatory consumer laws in your place of residence.
